Summary
On 11th November 2013, the Supreme Court released a new provision to push forward the online publication of judgments in China. A new website is also set up by the Supreme Court to post valid judgments of all levels of courts. The provision requires disclosure of litigants’ names and other personal information, which arose a human right concern on right to privacy, as well as a debate on balance between public interests and private interest. This debate is raised again when it comes to further online distribution of judgments. Therefore, this paper will analyze the conflicted interests, and looking for manners to deal with the debate and human right concern both on judgment publication and distribution on the Internet.
